Holding

Regular bail was denied to the petitioners.

Summary

The petitioners Gajendra Kumar, Nitish Kumar and Sudhir Kumar applied for regular bail in connection with PS Case No. 87 of 2025, which alleges offences under Sections 191(2), 190, 103(1), 303 of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The FIR alleges that the accused fired indiscriminately, causing the death of one person, injury to another, and looted Rs. 5 lakhs. The petitioners contended that the post‑mortem report did not conclusively show a firearm injury to the deceased, while the informant’s medical officer testified that the victim had three bullet wounds. The Court examined the seriousness of the charges, the medical evidence of bullet wounds, and the alleged loot. Considering these factors, the Court was not inclined to grant regular bail. Consequently, the applications for regular bail were rejected, with the observation that the remarks are prima facie and will not affect the trial.

Issues considered

  • Whether regular bail should be granted to the accused persons in view of the alleged murder, attempted murder, possession of arms and loot allegations.
