Patna High Court

Raju Kumar Yadav @ Raju KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed the petition for regular bail, directing the petitioner to be released on bail.

Summary

The petitioner, Raju Kumar Yadav, applied for regular bail in a case registered under Sections 103(1), 123, 238 and 3(5) of the B.N.S., where he is alleged to have murdered his wife. The prosecution alleges he killed the deceased, while the petitioner claims the deceased committed suicide after informing him, and asserts his innocence and clean antecedent. The petitioner has been in custody since 5 June 2025 and undertook to cooperate with the trial. The State opposed the bail, but the court noted that no witness had been examined at trial. Considering these factors, the court allowed the bail application, directing the petitioner to furnish a bail bond of Rs. 10,000 with two sureties of the same amount.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the serious nature of the offences alleged.
  • Whether the absence of any witness examination at trial warrants the grant of bail.
