Patna High Court

Anish Raj @ Anish Thakur @ ANISH KUMARversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court denied bail to the petitioner.

Summary

The petitioner, Anish Raj, applied for regular bail in a case registered under Section 392 of the Indian Penal Code for an alleged road robbery on 1 March 2024, during which he was accused of snatching cash and documents from an informant at gunpoint. The petitioner contended that he was falsely implicated, not named in the FIR, and that the only evidence against him was a self‑confessional statement made while in police custody, which he claimed lacked evidentiary value. The State opposed bail, highlighting the petitioner’s extensive criminal record of eighteen cases, including offences under the Arms Act, portraying him as a habitual offender. The court examined the record, noted the seriousness of the robbery charge and the petitioner’s prior convictions, and found no sufficient ground to grant bail. Consequently, the court rejected the bail application.
