Patna High Court

Rajnish Kumar @ Raja @ R.K. SinghversusThe State of Bihar

DISMISSED

Holding

The court held that the petitioner is not entitled to anticipatory bail in the present case.

Summary

The petitioner, Rajnish Kumar, sought anticipatory bail in connection with a murder case (Pakaridayal P.S. Case No. 35 of 2025) involving offences under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of the Arms Act. The prosecution alleged that the petitioner, along with others, killed the deceased, whose wife (the informant) was in a relationship with another man. The court examined the seriousness of the alleged offences and the circumstances surrounding the murder. It concluded that the petitioner did not merit the protection of anticipatory bail given the gravity of the charges. Consequently, the earlier interim protection was vacated, the anticipatory bail application was rejected, and the petitioner was ordered to surrender within two weeks to seek regular bail, failing which he would be arrested.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under the Bharatiya Nyaya Sanhita, 2023 and the Arms Act in view of the alleged murder.
  • Whether the seriousness of the alleged offences justifies denial of anticipatory bail.
