Patna High Court

Munna Sah @ StilwaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail is granted to the petitioner subject to stringent conditions.

Summary

Munna Sah was arrested in a 2014 robbery case alleged under Sections 395 and 397 of the Indian Penal Code, involving the hijacking of a truck and assault on the driver. The prosecution’s case is that a group of four miscreants committed the robbery on 17 October 2014 and fled, leaving the victims injured. The petitioner argued that he was falsely implicated, was not named in the FIR, and his name surfaced only from a co‑accused’s confessional statement; no incriminating material was recovered from him and no identification parade had been conducted. He had been in judicial custody since March 2020 while two co‑accused had already been granted bail. The court, after weighing the facts and submissions, ordered his release on bail with a surety of Rs 10,000 and several conditions, including regular reporting to the police and non‑tampering with evidence. The bail application was therefore allowed.

Issues considered

  • Whether bail can be granted to an accused in a dacoity/robbery case under Sections 395 and 397 IPC pending trial.
  • Whether the absence of the petitioner’s name in the FIR, lack of incriminating material and no identification parade justify granting bail.
