Decided

BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Gamha Yadav, applied for regular bail in a case (Laukariya P.S. Case No. 61 of 2025) alleging his involvement in the torture and murder of an informant's daughter over dowry demands. He claims he is innocent, merely a maternal father‑in‑law of the deceased, with no day‑to‑day involvement, and has a clean antecedent, having been in custody since 11‑08‑2025. The State opposed the bail, citing the serious nature of the offences under Sections 80(2) and 3(5) of the BNS, 2023. The court examined the allegations, the petitioner’s relationship to the victim, and his lack of direct involvement, and found no compelling reason to deny bail. Consequently, the court ordered his release on bail upon furnishing a bond of Rs.10,000 with two sureties, subject to his cooperation in the trial.

Issues considered

  • Whether regular bail should be granted to the petitioner in a case involving alleged dowry‑related murder under Sections 80(2) and 3(5) of the BNS, 2023.

                   learned APP for the State.

                                    2. In this case, the petitioner is seeking regular bail in

connection with Laukariya P.S. Case No. 61 of 2025, registered for

accused persons are said to have tortured the informant’s daughter for

demand of Rs. 4,00,000/- and a vehicle as dowry and ultimately, on

that the petitioner is innocent and has falsely been implicated in the

custody. The petitioner is a person of clean antecedent and is in

                       custody since 11.08.2025.

                                    5. On the other hand, the learned APP for the State has

no concern with day-to-day affairs of the couple.

                                    7. Considering the above-mentioned facts and

circumstances, let the petitioner above-named be released on bail on

furnishing bail bonds of Rs.10,000/- with two sureties of the like
