Anticipatory bail was granted to the petitioner subject to a bond, sureties and specific conditions of monthly payment to the complainant.
Summary
The petitioner, Ranjan Kumar, sought anticipatory bail in a complaint alleging dowry harassment and assault under IPC Sections 498A and 323. Mediation efforts had failed, and the prosecution alleged that the petitioner demanded dowry and subjected his wife to cruelty. The petitioner denied the allegations but offered to pay Rs.3,000 per month to the complainant as temporary relief. The State and the complainant opposed the bail. The Court, considering the petitioner's undertaking and the failure of mediation, granted anticipatory bail on a Rs.10,000 bond with two sureties and imposed conditions including monthly payments, verification of the complainant's bank account, and cancellation of bail for non‑payment.
Issues considered
- Whether anticipatory bail should be granted to the petitioner accused under Sections 498A and 323 of the IPC.
- Whether the conditions imposed by the Court, including a monthly monetary payment to the complainant, are appropriate and lawful.
- Whether the failure of mediation influences the decision to grant bail.
