Patna High Court

Chandrika DasversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court confirmed the provisional bail granted to the petitioner, subject to a monthly maintenance payment to the complainant.

Summary

The petitioner, Chandrika Das, sought protection from arrest in a dowry‑related assault case (Sheohar Mahila P.S. Case No.02 of 2022) involving alleged offences under Sections 341, 323, 498(A) and 504/34 of the Indian Penal Code. The prosecution alleged that the petitioner and others assaulted the victim to demand dowry, while the petitioner claimed false implication. The High Court, after hearing counsel for both sides, confirmed the provisional bail previously granted on 1 December 2025. The Court imposed a condition that the petitioner pay a maintenance amount of Rs 7,000 per month to the complainant, effective from March 2026, subject to any family‑court maintenance order. The Court warned that failure to comply could lead to cancellation of bail and directed communication of the order to the Principal District & Sessions Judge, Sheohar.
