Patna High Court

Sunila Sinha @ Sunil SinhaversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner subject to a bond of Rs.10,000, two sureties, and compliance with the stipulated statutory conditions.

Summary

Sunila Sinha, a former teacher, was accused of forging certificates to obtain her appointment and faced charges under IPC sections 409, 420, 467, 468, 471 and 120‑B. She had already been terminated from service and claimed no prior criminal record. The State opposed her bail application. The Court considered the seriousness of the allegations, her termination, and the lack of antecedents, and ordered that she be released on bail if arrested or surrendered within four weeks, upon furnishing a Rs.10,000 bond with two sureties. Bail was conditioned on compliance with Section 438(2) of the Cr.P.C. and Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023. The petition for bail was therefore allowed.

Issues considered

  • Whether bail should be granted to the petitioner despite the serious IPC offences alleged against her.
  • Whether the conditions prescribed under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS, 2023, are satisfied for granting bail.
