Decided
Disposal
BAIL GRANTED

Holding

The court allowed anticipatory bail to the petitioner, subject to conditions under Section 482(2) of the B.N.S.

Summary

The petitioner, Pintu Kumar Yadav, feared arrest in a case alleging assault with a sharp-edged weapon under several sections of the B.N.S. The prosecution alleged he injured the son of an informant, while the petitioner claimed innocence, clean antecedents, and that the injuries were minor. The State opposed his request for anticipatory bail. The court, considering the nature of the alleged injuries and the petitioner’s clean record, granted anticipatory bail. The bail was conditioned on a Rs.10,000 bond, two sureties of equal amount, and compliance with Section 482(2) of the B.N.S. The order remains effective for eight weeks from the date of the order.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the circumstances of the alleged assault.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses.
