The court granted regular bail to the petitioners on furnishing a bail bond of Rs.10,000 each with two sureties.
Summary
The petitioners, Manohar Pasi, Rohit Kumar and Priyanka Devi, applied for regular bail in a case registered under Sections 304B and 34 of the Indian Penal Code for the alleged murder of a woman over dowry demands. The prosecution alleged that the petitioners, who are relatives of the deceased, played an active role in the killing, while the petitioners contended they had no involvement and the allegations were vague. The State opposed bail, asserting their participation in the crime. The court noted that the husband of the deceased was already in custody and the accusations against the petitioners were general, and therefore ordered that bail be granted on a bond of Rs.10,000 each with two sureties. The application for bail was allowed.
Issues considered
- Whether the petitioners are entitled to regular bail despite the serious nature of the offences under Sections 304B and 34 IPC.
- Whether the prosecution's allegations constitute sufficient ground to deny bail.
