BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a bond and sureties.

Summary

The petitioner, Shambhu Das, was arrested in connection with a case registered under multiple IPC sections including 420, 467, 468, 406, 376, 323, 504 and 506, alleging that he raped a married woman under the pretext of marriage. The petitioner claimed innocence, asserting that the sexual relationship was consensual and that he was falsely implicated. The victim, a divorced lady, admitted to a love relationship with the petitioner but also alleged rape. The State opposed bail, citing the seriousness of the offences. After considering the facts, the court ordered the release of the petitioner on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to his cooperation in the trial.

Issues considered

  • Whether regular bail should be granted in a case involving alleged rape and other serious offences under the IPC
  • Whether the alleged consensual nature of the relationship negates the seriousness of the charges
