Sonu KumarversusThe State of BIhar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to regular bail in the present case.

Summary

Sonu Kumar was arrested in connection with a case registered under Section 140(2) of the Bihar Narcotic Substances Act after a police raid rescued an injured victim who alleged assault and a ransom demand. The petitioner claimed he was falsely implicated, arguing that the informant and co‑accused were friends and that the ransom allegation was fabricated. He highlighted his clean antecedent and noted that other co‑accused had already been granted bail by the same court. The State opposed the bail, but the court considered the lack of strong incriminating material and the petitioner’s cooperation. Consequently, the court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to his cooperation in the trial.
