Patna High Court

MD. ZYAOUL HAQUEversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court exercised its inherent powers under Section 482(2) of the B.N.S.S. to grant anticipatory bail to the petitioner, subject to specified conditions.

Summary

The petitioner, Md. Zyaoul Haque, was apprehensive of arrest in a dowry‑related case (Siwan Mahila P.S. Case No. 129 of 2024) alleging offences under Sections 115(2), 126(2), 85, 351(3), 3(5) of the B.N.S. and Section ¾ of the D.P. Act. He claimed the FIR was filed retaliatorily after a matrimonial dispute and denied any dowry demand or cruelty. The opposite party, Nagma Khatoon, alleged physical and mental torture and demanded maintenance. The petitioner’s counsel offered to pay Rs 3,000 per month as “living cost” and to surrender the complainant’s educational certificates, which the opposite party’s counsel accepted. The Court, after hearing both sides, granted anticipatory bail to the petitioner, imposing a bail bond of Rs 10,000 with two sureties and conditioning the bail on monthly payments of Rs 3,000 to the opposite party and surrender of the certificates, invoking its inherent powers under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the serious dowry‑related allegations.
  • Whether the conditions imposed (monthly payment and surrender of certificates) are appropriate and within the scope of Section 482(2) of the B.N.S.S.

innocent and he has not committed any offence in the manner

house on her own volition and started residing at ‘maikey’ and

threatened the petitioner of dire consequences as such the

petitioner filed an informatory petition before the S.D.J.M.,

prejudice to the right and contention of the petitioner and in

order to maintain harmony in the family, the petitioner under-
