Holding
The court held that regular bail cannot be granted where the offences are grave and the petitioner has a criminal antecedent.
Summary
The petitioner, Manish Kumar (also known as Manish Singh, Manish Rai, Nanki, Jitendra Rai, Jitendra Ray, Jitendra Singh), applied for regular bail in a case registered as Bidupur Police Station Case No. 428 of 2019, which alleged offences under Sections 307 and 353 of the Indian Penal Code and Section 27 of the Arms Act. The prosecution alleged that the accused had fled from the police, were later apprehended, and that one of the accused fired at police personnel. The petitioner had previously sought bail, which was rejected on 19 May 2023 on the ground of his criminal antecedents. The learned High Court, after hearing counsel, considered the seriousness of the alleged offences and the petitioner’s past record and concluded that bail could not be granted. Consequently, the application for regular bail was dismissed and the trial court was directed to frame charges and expedite the trial.
Issues considered
- Whether regular bail should be granted to the petitioner despite the seriousness of the offences under IPC §§307, 353 and Arms Act §27
