Patna High Court

Anoj KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

The petitioner, Anoj Kumar, sought regular bail in a case registered under sections 308(5) and 3(5) of the BNS, alleging that he was falsely implicated and not named in the FIR. The prosecution alleged that unknown miscreants assaulted a worker at a construction site and that the petitioner’s name surfaced only through confessional statements of co‑accused Rahul Kumar and Sonu. The petitioner argued that no material evidence besides the confessional statements linked him to the crime and highlighted that a co‑accused had previously been granted bail. The State opposed bail, citing the petitioner’s two prior criminal antecedents. Considering the lack of substantive evidence and the petitioner’s prolonged custody since June 2025, the court inclined to grant bail, directing release upon furnishing a bail bond of Rs.10,000 with two sureties.

Issues considered

  • Whether regular bail should be granted to the petitioner despite the confessional statements of co‑accused.
  • Whether the petitioner’s prior criminal antecedents preclude the grant of bail.
  • Whether the absence of the petitioner’s name in the FIR and lack of other evidence justify bail.

investigation, one Rahul Kumar and Sonu allegedly made

confessional statement and solely on the basis of such statement,

the name of the petitioner has surfaced. It is further submitted

that save and except the confessional statement, nothing has

come against this petitioner to implicate him. It is contended

                                   6. Considering the aforesaid facts and circumstances
