Ranjeet SinghversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner on condition of a Rs.10,000 bond and two sureties.

Summary

Ranjeet Singh, the tenth of eleven accused, was charged with embezzling Rs.1.54 crore of government funds under Sections 316(5), 318(4) and 3(5) of the BNS. He applied for regular bail, contending that the FIR only made a general, omnibus allegation against him and did not specify any amount he had taken. The petitioner's counsel also highlighted that the President of the Pax Committee had undertaken to deposit the entire embezzled sum. The State opposed the bail application. After hearing both sides, the court granted bail, directing the petitioner to furnish a bail bond of Rs.10,000 along with two sureties of the same amount, to be satisfied before the Chief Judicial Magistrate, Sheikhpura.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged under Sections 316(5), 318(4) and 3(5) of the BNS.
  • Whether the general nature of the allegations and the undertaking by the Pax Committee affect the grant of bail.
