Patna High Court

Meera DeviversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court allowed regular bail, considering the period of custody and the petitioner being a woman.

Summary

Meera Devi, a woman, was arrested in connection with a murder case (Kamtaul P.S. Case No. 2 of 2025) and charged under several sections of the Bharatiya Nyaya Sanhita, 2023, including offences relating to homicide and weapon use. She claimed innocence, asserting that the knife alleged to be used by her fell from the prosecution’s house, and had been in custody since 2 January 2025. The State opposed her bail application, while the petitioner’s counsel argued for her release. The Patna High Court, noting the length of her pre‑trial detention and her status as a woman, allowed her regular bail on a bond of Rs. 10,000 with two sureties. Consequently, she was ordered to be released pending trial.

Issues considered

  • Whether the petitioner is entitled to regular bail despite being charged with serious offences under the Bharatiya Nyaya Sanhita, 2023
  • Whether the petitioner’s gender and period of pre‑trial custody warrant the grant of bail
