Holding

The court granted anticipatory bail to the petitioners subject to a bail bond and conditions under Section 482(2) of the B.N.S.

Summary

The petitioners, three residents of Utrapatti village, sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 109, 303(2), 352, 351(2) and 3(5) of the B.N.S. for allegedly assaulting an informant and his children. The State opposed the bail, contending the offences were serious. The petitioners argued they were innocent, the injuries were minor, and they had clean antecedents. The court examined the nature of the injuries, the petitioners' background and the circumstances of the dispute, and found no justification to deny bail. Consequently, the court granted anticipatory bail, directing the petitioners to furnish a bail bond of Rs.10,000 each with two sureties, subject to conditions under Section 482(2) of the B.N.S.
