BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioners subject to a bail bond and sureties under Section 482(2) of the B.N.S.S.

Summary

The petitioners, five residents of Daulatpur village, sought anticipatory bail fearing arrest in a case (PS Case No. 328 of 2025) alleging offences under multiple sections of the B.N.S. The prosecution alleged that the petitioners, along with other accused, assaulted an informant and his family using iron rods, lathis and a pistol. The petitioners contended they were innocent, stating that both parties belong to the same lineage and the incident arose from a trivial dispute, resulting in mutual injuries and a counter‑case. The State opposed the bail application. Considering the factual matrix, the existence of a case‑and‑counter‑case, and the petitioners' clean antecedents, the Court granted anticipatory bail, directing each petitioner to furnish a bail bond of Rs 10,000 with two sureties, subject to Section 482(2) of the B.N.S.S.

2 19-02-2026 Heard learned counsel appearing on behalf of the

petitioners and learned APP appearing on behalf of the State.

                                2. The petitioners apprehend their arrest in a case

registered for the offence punishable under Sections 191(2),

                   191(3), 190, 126(2), 115(2), 117(2), 110, 74, 352, 351(2) and

                   324(2) of the B.N.S..

                                3. As per prosecution case, it is alleged that all the

F.I.R. named accused persons, including these petitioners,

abused and assaulted informant and his family members by

means of iron rod, lathi and pistol.

                       4. It is submitted by learned counsel appearing on

behalf of the petitioners that petitioners are quite innocent and

have committed no offence. As a matter of fact, both parties are

descendants of the same ancestor and on account of trivial

dispute, altercation took place which led to maar-peet between

the parties in which both sides sustained injuries. There is case

and counter-case. The present case is counter-blast of Konch

P.S. Case No. 327 of 2025 which was lodged by petitioners’ side

against informant and others. Petitioners claim clean

          antecedents.

                       5. Learned A.P.P. for the State has vehemently

opposed the prayer for grant of anticipatory bail to the

          petitioners.

                       6. Considering the facts and circumstances of the

case, case and counter-case between the parties and clean

antecedents of the petitioners, the prayer for grant of

anticipatory bail to the petitioners is allowed.

                       7. Accordingly, in the event of arrest/surrender within

a period of eight weeks from today, let the above named

petitioners be enlarged on bail on furnishing bail-bond of Rs.
