Patna High Court

Manu Kumar @ Monu KumarversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court held that bail could not be granted to the accused and dismissed the application.

Summary

Manu Kumar, accused of stabbing and murdering a person under Sections 326, 302 and 34 of the Indian Penal Code, applied for regular bail for the second time. The trial is underway with four of seven witnesses already examined. The petitioner argued that the trial progress warranted bail, but the State contended that he is the principal assailant. The High Court, noting the seriousness of the offences and the petitioner’s role as the assailant, found no merit to revisit its earlier order denying bail. Consequently, the bail application was dismissed and the trial was directed to be expedited.

Issues considered

  • Whether regular bail can be granted to an accused of murder and grievous hurt under Sections 326, 302 and 34 IPC.
  • Whether the progress of trial and examination of witnesses justify granting bail.
