Patna High Court

Manish Kumar Sah @ Manish Kumar @ Manish SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner upon furnishing a bail bond of Rs. 10,000 with two sureties.

Summary

Manish Kumar, husband of a woman who allegedly committed suicide, was arrested in connection with a case arising from PS Saur Bazar, Saharsa. He had been in custody since September 4, 2023 and the charge had already been framed. His earlier bail application was rejected on April 26, 2024. The petitioner argued that he was falsely implicated and maintained a clean antecedent, emphasizing the prolonged custody and slow progress of the trial. The court, considering these factors, ordered that he be released on bail upon furnishing a bail bond of Rs. 10,000 with two sureties of the same amount, to the satisfaction of the Additional Sessions Judge-IV, Saharsa.

Issues considered

  • Whether the petitioner is entitled to bail given the length of custody and alleged delay in trial
  • Whether the petitioner’s claim of innocence and clean antecedent warrant bail

Subjects

  • bail
  • criminal procedure
  • custody
  • trial delay
  • false implication
  • suicide
