Summary

Petitioner Parmendra Yadav applied for anticipatory bail fearing arrest in a case (PS No.175 of 2025) alleging offences under Sections 191(2), 190, 126(2), 115(2), 118(1), 109(1), 352 and 351(2) of the Bihar Penal Code. The prosecution alleges that the petitioner assaulted the victim with a lathi, although the victim sustained no injury. The petitioner contended that he was falsely implicated and maintained his innocence. The learned counsel for the State opposed the bail, highlighting the seriousness of the allegations and the petitioner’s six prior criminal antecedents. The Court, after considering the nature of the allegations and the petitioner’s criminal record, declined to grant anticipatory bail and dismissed the application.
