The court granted regular bail subject to conditions, but upon the petitioner's request, the bail application was withdrawn and dismissed.
Summary
The petitioners Kundan Kumar Chaubey and Vishal Singh applied for regular bail in a murder‑conspiracy case (Shikarpur P.S. Case No. 975 of 2022) involving offences under IPC sections 302, 307, 34, 120B and Arms Act section 27. Their earlier bail plea had been rejected and they had been in custody since May 2023, with the trial still pending and only six of fourteen witnesses examined. The petitioners claimed false implication and pointed out that other co‑accused had been granted bail. The State opposed the bail. The court allowed regular bail on the condition of weekly police attendance and cooperation with the trial, requiring a bail bond of Rs.10,000 with two sureties. Subsequently, the petitioners sought to withdraw the bail application, permission was granted, and the application was dismissed as withdrawn.
Issues considered
- Whether regular bail should be granted to an accused of murder and conspiracy under IPC and Arms Act given prolonged pre‑trial detention and trial delays.
- Whether a bail application, once granted, can be withdrawn by the petitioner.
