Patna High Court

Nawal Kishor @ Nabal PanjiyaraversusThe State of Bihar

Decided

REJECTED

Bail was denied because the serious nature of the offences, the petitioners’ delayed surrender, and their criminal antecedents outweighed any claim of false implication.

Summary

The petitioners, Anil Panjiyara and Nawal Kishor Panjiyara, were arrested in connection with a 2016 FIR (Amarpur PS Case No.357) alleging they shot the father‑in‑law of an informant, leading to his death, and were charged under several IPC sections and Section 27 of the Arms Act. They sought bail, claiming false implication and pointing to the earlier grant of bail to a co‑accused, Dilip Panjiyara, in a similar case. The State opposed bail, emphasizing the serious nature of the alleged firing, the petitioners’ late surrender in 2025, and their criminal antecedents. The Court examined the gravity of the charges, the delay caused by the petitioners’ surrender, and their prior criminal record. Concluding that the allegations were serious and the delay substantial, the Court refused to grant bail to both petitioners.

Issues considered

  • Whether bail should be granted to accused persons charged with serious offences under the IPC and Arms Act despite alleged false implication.
  • Whether the delay in surrender and the petitioners’ criminal antecedents justify denial of bail.

petitioners in connection with Amarpur P.S. Case no.357 of

          2016 registered under sections 147, 148, 149, 341, 323, 302,

506 of Indian Penal Code and Section 27 of the Arms Act.

                       4. Allegation in the F.I.R. is that the petitioners along

with others shot the father-in-law of the informant, causing him

          to succumb to his injuries.

                       5. Learned counsel for the petitioners submits that

petitioners have been falsely implicated in the case on account

of pending criminal case with regard to murder of petitioner’s

father. It has also been submitted that 21 persons have been

named in the F.I.R and co-accused Dilip Panjiyara has been

granted bail by a co-ordinate Bench of this Court vide order

dated 18.04.2019 passed in Cr. Misc. No. 79268 of 2018 with

almost similar allegations (Annexure-P/2). The petitioner nos. 1

and 2 are in custody since 14.02.2025 and 17.05.2025

respectively and undertake to cooperate in the case/trial.

                       6. The application for bail is opposed by learned

A.P.P. for the State on the ground that there is a direct allegation

against the petitioners of firing upon the deceased. Since the

case is of the year 2016, the petitioners have already delayed the

proceedings by their late surrender in the year 2025.

                       7. Taking into consideration the rival contention of the

parties and also considering the fact that there are serious

allegations of opening firing against the petitioners coupled with

the fact that enough delay has been caused on account of late

surrender of these petitioners and also they have chequered

history of criminal antecedents, this Court is not inclined to
