Patna High Court

Ankit KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted bail to the petitioner.

Summary

Ankit Kumar was arrested in connection with a kidnapping and alleged murder under Sections 364 and 120B of the IPC. He sought bail, contending that his name appeared only through a co‑accused's confessional statement and that the victim did not identify him, with no other incriminating material. The prosecution argued his involvement and highlighted his antecedent criminal cases. The court noted that the investigation was complete, a charge‑sheet had been filed, and there was no risk of evidence tampering, finding the suspicion insufficient to deny bail. Accordingly, the court ordered his release on bail with a Rs.10,000 bond and two sureties, subject to conditions under Section 437(3) CrPC and Section 480(3) BNSS.

Issues considered

  • Whether bail should be granted in offences punishable under Sections 364 and 120B of the IPC when the only link is a co‑accused's confessional statement.
  • Whether the completion of investigation and filing of charge‑sheet preclude the risk of evidence tampering, justifying bail.
  • Whether the petitioner’s prior criminal antecedents warrant denial of bail.
