Patna High Court

Ranjit Kumar Yadav @ Ranjit RaiversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The bail application was rejected, and the petitioner was not entitled to regular bail at this stage.

Summary

The petitioner, Ranjit Kumar Yadav, was charged under Sections 304B and 34 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act in a case arising from Sonepur Police Station. He applied for regular bail after being in custody since 5 September 2025, having clean antecedents and the trial still pending. The trial court had earlier rejected his bail application and was directed to expedite the trial. The State opposed bail, noting that three of six prosecution witnesses had already been examined and the trial was expected to conclude within six months. The High Court considered the stage of the trial, the seriousness of the offences, and the likelihood of tampering with evidence. Consequently, the Court refused to grant bail and dismissed the petition.

Issues considered

  • Whether regular bail should be granted to an accused charged with culpable homicide not amounting to murder and dowry death when the trial is ongoing.
  • Whether the stage of the trial and the examination of prosecution witnesses justify denial of bail.

the trial has not been concluded. Counsel also submits that on

the previous occasion, a report regarding the present stage of the

three prosecution witnesses have been examined, and it has been

indicated by the Trial Court that the trial is expected to be

                                 5. In the present facts and circumstances of this case

and the submissions made above, this Court is not inclined to

application of the petitioner is hereby rejected.

                                                                        (Dr. Anshuman, J.)
