The court allowed the application for regular bail, subject to specified conditions.
Summary
The petitioners, Bhuwali Yadav and Raj Mohan Yadav, were arrested in connection with a case involving the alleged possession of 6.2 kg of ganja and charged under Section 317(5) of the Bihar Narcotic Substances Act and Sections 8 and 20(b)(ii)(B) of the NDPS Act. They had been in custody since 20 January 2025 and had previously applied for regular bail, which was denied on 23 April 2025. Claiming false implication and having a clean antecedent, they reapplied for bail, undertaking to cooperate with the trial. The State opposed the bail, but the court, noting the prolonged custody and trial delay, allowed the regular bail application. The bail was granted on the condition that each petitioner furnish a Rs. 10,000 bond with two sureties and attend the police station every Sunday, as well as cooperate with the trial proceedings, with non‑compliance leading to cancellation of bail.
Issues considered
- Whether regular bail should be granted to the accused in a narcotics case involving possession of a large quantity of ganja.
- Whether the period of custody and delay in trial justify the grant of bail despite the seriousness of the offence.
