Bail may be granted where the accused is only alleged to have been present at the scene, but must be denied where a direct allegation of rape is made against the accused.

Summary

The Patna High Court heard two bail applications arising from the same police case (Bachwara PS Case No. 131 of 2025) involving alleged offences under Sections 64, 3(5) of the Bihar Narcotic Substances Act, Section 4 of the POCSO Act and Sections 3(i)(w), 3(2)(V) of the SC/ST Act. In the first application, the petitioner Shubham Kumar claimed he was merely present at the scene and not a participant in the alleged rape; the court, noting the lack of a direct allegation against him and the length of his custody, granted bail on a bond of Rs.10,000 with two sureties. In the second application, the petitioner Prakash Kumar Choudhary faced a direct allegation of rape; the court considered the seriousness of the charge and refused bail, dismissing the application. In both orders the court clarified that its observations were limited to the bail applications and did not prejudice the merits of the trial.

Issues considered

  • Whether bail should be granted to a petitioner who is only alleged to have been present at the scene of a rape under the BNS, POCSO and SC/ST Acts.
  • Whether bail should be denied to a petitioner directly accused of rape under the same statutes.
