Pratap SinghversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court refused to grant anticipatory bail to the petitioner.

Summary

Petitioner Pratap Singh, a member of the Panchayat Teacher Niyozan Committee, was alleged to have conspired with Neelam Kumari to facilitate her selection using forged certificates, leading to charges under IPC sections 420, 467, 468, 120B and 471. He applied for anticipatory bail fearing arrest in the case (Pranpur P.S. Case No. 201 of 2022). The High Court examined the seriousness of the allegations and the nature of the offences. It concluded that the circumstances did not merit the grant of anticipatory bail. Consequently, the application was rejected, and the petitioner was ordered to surrender within two weeks and seek regular bail, with the police directed to arrest him if he fails to do so. The order was limited to the present application and does not prejudice any later proceedings.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Criminal Procedure Code in view of the alleged offences under IPC sections 420, 467, 468, 120B and 471.
