DISMISSED

Holding

The bail petition was rejected because the petitioner deliberately concealed the fact that his earlier bail application had been refused.

Summary

The petitioner, Indrajeet Kumar, applied for bail before the Patna High Court. During the hearing, counsel for the informant highlighted that the petitioner had failed to disclose a prior bail application (Cr. Misc. No.12838 of 2025) which had been rejected. The court ordered an enquiry into how the erroneous note was generated and identified the officer responsible, who offered an unconditional apology. The petitioner’s deliberate concealment of the earlier refusal, as well as the deponent’s similar omission, was noted by the court. Consequently, the bail petition was rejected. The Registrar General was directed to conduct a further enquiry and take appropriate action against the erring officials.

Issues considered

  • Whether bail should be granted when the petitioner deliberately concealed a prior bail refusal.
  • Whether the concealment constitutes misconduct warranting rejection of the bail application.
  • Whether procedural irregularities in the court’s note require an enquiry and disciplinary action.
