Patna High Court

Vinit AnandversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The High Court granted anticipatory bail to the petitioner.

Summary

The petitioner, Vinit Anand, sought anticipatory bail fearing arrest in a case registered under Sections 103(1) and 61(2) of the B.N.S. and Section 27 of the Arms Act concerning the murder of Ranjan, who was allegedly forced into a vehicle and shot. The FIR does not name the petitioner; the only link is his appearance in CCTV footage with a co‑accused, and no other incriminating material exists. The petitioner asserted innocence and clean antecedents, while the State opposed the bail. The Court, considering the lack of direct evidence, the general nature of the accusation and the petitioner’s clean record, granted anticipatory bail subject to a bond of Rs 10,000 with two sureties and conditions under Section 482(2). The order directs that if arrested within eight weeks, the petitioner be released on bail.

Issues considered

  • Whether anticipatory bail should be granted when the petitioner is not named in the FIR and the only material is CCTV footage.
  • Whether the material on record justifies the issuance of a warrant of arrest.
  • Whether the conditions under Section 482(2) of the B.N.S.S. are applicable to the grant of anticipatory bail.
