DISMISSED

Holding

The court held that bail could not be granted as the petitioner was an absconder and the allegations were serious.

Summary

The petitioner, Abhay Yadav, was charged with murder under Sections 302/34 of the Indian Penal Code, illegal possession of a firearm under Section 27 of the Arms Act, and an offence under Section 17 of the CLA Act. A dead body with a gunshot wound was discovered, and the petitioner was alleged to be involved. He has been in custody since 30‑06‑2025 and is described as an absconder, also facing 32 other cases (acquitted in 23 and on bail in 9). The petitioner applied for regular bail. The court examined the seriousness of the charges, his absconding status, and his criminal antecedents, and concluded that these factors warranted denial of bail. Consequently, the bail application was dismissed.
