Md. SaddamversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The court denied regular bail to the petitioner.

Summary

The petitioner, Md. Saddam, applied for regular bail in a case registered under Sections 25(1‑B)(a) and 26 of the Arms Act for allegedly possessing a country‑made pistol and live cartridges. He claimed innocence and alleged false implication, having been in custody since 19‑Oct‑2025. The State opposed bail, contending that the petitioner is involved in two other similar cases. The bench considered the seriousness of the arms offences and the alleged repeat involvement, and consequently declined to grant bail. The judge directed that the petitioner may file a fresh bail application after six months of custody.

Issues considered

  • Whether regular bail should be granted to the accused under Sections 25(1‑B)(a) and 26 of the Arms Act.
  • Whether the existence of alleged involvement in other similar cases warrants denial of bail.

as learned APP for the State.

                                   2. In this case, the petitioner is seeking regular bail

in connection with Alamganj P.S. Case No. 1110 of 2025,

registered for the offences punishable under Sections 25(1-B)

                   (a), 26 of Arms Act.

                                   3. As per allegation, the petitioner was arrested with

a country-made pistol and two live cartridges.

                                  4. The learned counsel for the petitioner has

submitted that the petitioner is innocent and has falsely been

implicated. He is under custody since 19.10.2025.

                                 5. On the other hand, the learned APP for the State

has opposed the prayer for bail by submitting that the petitioner

is involved in two other cases of similar nature.

                                  6. Considering the above-mentioned facts and

circumstances, presently, I am not inclined to grant bail to the

                     petitioner. Accordingly, it is rejected.

                                  7. However, the petitioner, if so advised, may renew

his prayer for bail after remaining six months under custody.
