The Court granted anticipatory bail to the petitioner, subject to specified conditions.

Summary

Petitioner Nitesh S. Sharma applied for anticipatory bail fearing arrest in a dowry‑related assault case (Complaint No. 1137(C) of 2024). The prosecution alleged that he and others assaulted the victim to demand dowry, invoking sections 60, 318(4), 316(2), 303(2), 85 of the Bharatiya Nyaya Sanhita, 2023 and a provision of the Dowry Prohibition Act. The petitioner claimed innocence and sought protection under Section 438 of the CrPC. The Court, relying on the Supreme Court’s guidelines in Arnesh Kumar v. State of Bihar, held that the circumstances warranted anticipatory bail. Accordingly, the Court ordered release on bail with a bond, sureties and a condition to pay monthly maintenance to the informant, subject to the usual conditions of Section 438(2) CrPC and Section 482 BNYS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nyaya Sanhita and the Dowry Prohibition Act.
  • Whether the principles laid down in Arnesh Kumar v. State of Bihar apply to restrain unnecessary arrest in this case.
