Patna High Court

Neeraj KumarversusThe State of Bihar

Decided
Disposal
BAIL REJECTED

Holding

The court held that bail could not be granted as the quantity of ganja seized justified denial of bail.

Summary

The petitioners, Vijay Kumar and Neeraj Kumar, have been in judicial custody since 25 May 2024 for alleged possession of a large quantity of ganja (approximately 37.457 kg) seized from a Renault car, under Sections 8, 20B and 22 of the NDPS Act. Their earlier bail application was rejected, and they filed a second bail petition before the Patna High Court. The prosecution contended that the substantial quantity of narcotic justified denial of bail, while the petitioners argued that the trial had not yet commenced despite the charges being framed. The Court, after considering the submissions, declined to grant bail, emphasizing the seriousness of the offence given the large seizure. However, the Court directed the trial court to expedite the trial and aim to conclude it within nine months. The bail petitions were therefore dismissed.

Issues considered

  • Whether bail should be granted to accused persons under the NDPS Act for possession of a large quantity of ganja.
  • Whether the quantity of narcotic seized (approximately 37.457 kg) warrants denial of bail.
  • Whether the delay in trial commencement infringes the petitioners' right to a speedy trial.
