Decided
Disposal
BAIL GRANTED

Holding

Considering the nature of injury and the petitioners' clean antecedent, the Court granted anticipatory bail subject to conditions under Section 482 of the Bhartiya Nyaya Sanhita, 2023.

Summary

The petitioners, Md. Kasid Ali and Md. Zishan, sought anticipatory bail fearing arrest in a case arising from a pre‑existing land dispute that led to a melee where the informant was allegedly assaulted with a hockey stick, resulting in simple injury. The FIR charges them under Sections 329(4), 126(2), 115(2), 352, 109 and 3(5) of the Bhartiya Nyaya Sanhita. The informant opposed the bail application. The Court, noting the minor nature of the injury and the petitioners' clean antecedent, ordered that they be released on bail upon furnishing a bail bond of Rs 10,000 with two sureties each, subject to conditions under Section 482 of the B.N.S.S., 2023. The order was pronounced by Justice Prabhat Kumar Singh of the Patna High Court.
