Anticipatory bail was granted to the petitioners subject to a bail bond and conditions under Section 482 of the Bhartiya Nyaya Sanhita.
Summary
The petitioners, Chinta Devi, Ranju Devi and Ram Babu Yadav, sought anticipatory bail fearing arrest in a case registered under Sections 126(2), 115(2), 303(2), 110 and 191 of the Bhartiya Nyaya Sanhita for allegedly assaulting an informant and his wife with an iron rod and stealing a gold mangalsutra. The FIR described simple injuries and the petitioners claimed a clean antecedent. The State opposed the bail application. The Court considered the nature of the injuries, the clean antecedent and the possibility of surrender within eight weeks, and ordered that the petitioners be released on bail upon furnishing a bail bond of Rs.10,000 each with two sureties, subject to conditions under Section 482 of the B.N.S.S., 2023. The order effectively granted anticipatory bail to the petitioners.
