Patna High Court

Sunil RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The petitioner is entitled to bail after the lapse of the six‑month period and is released on bail upon furnishing the required bond and sureties.

Summary

The petitioner, Sunil Ram, was earlier denied bail by the Patna High Court on 13 May 2025 in Criminal Miscellaneous No. 17598 of 2025. The court had indicated that he could reapply for bail after a period of six months. On 16 February 2026, the petitioner filed a fresh bail application, asserting that the six‑month period had elapsed. The learned counsel for the petitioner, Mr. Rajeev Kumar, reiterated this ground and sought release on bail. The court examined the compliance with the stipulated period and, finding no contrary objections, ordered the petitioner’s release on bail upon furnishing a Rs.10,000 bond with two sureties of equal amount, subject to his cooperation in the trial.

Issues considered

  • Whether the petitioner is eligible to renew his bail application after the six‑month period prescribed in the earlier order
  • Whether the conditions of bail, including bond and sureties, are sufficient for the petitioner’s release

Subjects

  • bail
  • criminal procedure
  • high court
