Patna High Court

Vikram KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail is allowed to the petitioner subject to conditions.

Summary

Vikram Kumar sought anticipatory bail after learning that he might be arrested in a murder case (IPC Sections 302, 201/34) based on a co-accused's confession. The FIR does not name him; the only material against him is that he was in telephone contact with the co-accused, Ashok Kumar, at the time of the incident. The petitioner asserted a clean antecedent and argued there was no specific overt act linking him to the crime. The State opposed the bail application. The Court, considering the lack of concrete evidence, the nature of the accusation, and the petitioner's clean record, granted anticipatory bail subject to a bond and sureties, invoking Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail can be granted when the petitioner is not named in the FIR and only suspicion exists.
  • Whether Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023, permits the grant of anticipatory bail in such circumstances.
