Patna High Court

Lili Kumar @ Shivam KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner subject to a bail bond and specified conditions.

Summary

The petitioner, Lili Kumar, was arrested in connection with a murder case (Sections 103(1) and 3(5) of the BNS) after a dead body was found near Ghassiyari Gali drain. The deceased's father and brother alleged that the petitioner was seen at the scene, but no eyewitness testimony or substantive material linked the petitioner to the crime, and the investigation was completed without the need for further custodial interrogation. The petitioner sought regular bail, arguing lack of cogent evidence and that he had been in custody since 29‑04‑2025. The State opposed bail. The court, after considering the facts, directed that bail be granted on a bond of Rs.10,000 with two sureties, subject to conditions of cooperation and verification of any other criminal antecedents.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the seriousness of the offences under Sections 103(1) and 3(5) of the BNS.
  • Whether the absence of eyewitness evidence and lack of cogent material justify granting bail.
  • Whether the completed investigation and lack of need for further custodial interrogation affect the bail decision.
