Holding

The Court held that anticipatory bail could not be granted and dismissed the application.

Summary

The petitioners, Amar Kumar and Dharmendra Kumar, applied for anticipatory bail fearing arrest in a case (Parihar P.S. Case No. 201 of 2024) alleging abduction of a girl under IPC sections 363, 366 and 34. The prosecution alleged that the petitioners abducted the victim, while the petitioners claimed innocence and that the girl was in contact with her family. The informant opposed the bail, stating the girl remained missing. Considering the seriousness of the allegations and the fact that the missing girl had not been recovered, the Court declined to grant anticipatory bail. The petitioners were ordered to surrender within four weeks and to seek regular bail, and the Superintendent of Police was directed to form a special team to recover the girl within six weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners accused of abduction under IPC sections 363, 366 and 34.
  • Whether the circumstances justify denial of anticipatory bail and warrant the petitioners' surrender.
