Sugan ChaudharyversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to the stipulated conditions.

Summary

Petitioners Sugan Chaudhary and Krishna Chaudhary applied for anticipatory bail fearing arrest in a case (Sarmera P.S. Case No. 113 of 2025) alleging offences under several sections of the B.N.S., including assault with an iron rod. The prosecution alleged that the petitioners assaulted the victim, causing simple injuries. The petitioners contended they were falsely implicated, had a clean antecedent, and the injury was minor. The State opposed the anticipatory bail. The High Court, after considering the submissions, allowed the anticipatory bail, directing the petitioners to furnish a bail bond of Rs.10,000 each with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the B.N.S.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 438 of the CrPC in view of the alleged offences.
  • Whether the nature of the alleged offences and the petitioners' antecedents justify denial of bail.
