Holding
Anticipatory bail was denied because the offences alleged were of a serious nature affecting public order and communal harmony.
Summary
The petitioners – Gurjeet Singh, Ravi Singh, Manoj Agrawal and Rinku Singh – sought anticipatory bail fearing arrest in connection with PS Ramnagar Case No. 363 of 2017, wherein they were charged under multiple sections of the Indian Penal Code for offences including rioting, assault, and communal disturbance. The State of Bihar opposed the bail, contending that the allegations involved serious public order offences and communal tension. The Hon’ble Justice Sandeep Kumar examined the gravity of the charges and the potential threat to law and order. He concluded that the seriousness of the accusations outweighed the petitioners' claim for protection. Consequently, the court dismissed all anticipatory bail applications and ordered the petitioners to surrender within four weeks and apply for regular bail, warning of police action for non‑compliance.
