DISMISSED

Holding

Anticipatory bail was denied for the petitioners.

Summary

The petitioners, accused in a 2017 case (PS No. 363) for offences under several sections of the Indian Penal Code including public order offences and communal tension, applied for anticipatory bail fearing arrest. The prosecution alleged that they were involved in causing public disturbance and communal tension. The High Court, after hearing counsel, considered the seriousness of the allegations and the nature of the offences. It concluded that granting anticipatory bail would be inappropriate given the gravity of the charges. Consequently, the Court dismissed all anticipatory bail applications, directing the petitioners to surrender within four weeks and seek regular bail, failing which the police were instructed to arrest them.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners accused of offences under Sections 147, 148, 149, 323, 337, 427, 379, 153(A), 295, 295(A), and 296 of the Indian Penal Code.
