BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioner, subject to conditions under Section 438(2) CrPC and Section 482 BNSS.

Summary

The petitioner, Bipin Singh, sought anticipatory bail fearing arrest in a case (Khaira P.S. Case No. 310 of 2025) involving multiple offences under the Bihar Negotiable Security Act. The prosecution alleged that he assaulted a victim with an iron rod, causing injury. The petitioner claimed innocence, asserting the injury was minor and that he has a clean record. The State opposed the bail application. The Court, after considering the submissions, allowed the anticipatory bail, directing the petitioner to surrender within four weeks and furnish a bail bond of Rs. 10,000 with two sureties, subject to conditions under Section 438(2) of the CrPC and Section 482 of the BNSS.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 of the Code of Criminal Procedure, 1973 in view of the alleged offences under the BNSS.
