The Court granted bail to the petitioner subject to specified conditions.
Summary
The petitioner, Devjee Yadav, was charged under Section 309(4) of the B.N.S. for allegedly assaulting an informant and causing the theft of Rs.4,40,000. The FIR attributes the theft to other accused, Lalan Yadav and Raja Paswan, who have already been bailed, and suggests the petitioner only participated in a scuffle before being taken away by others. The petitioner had been in custody since 21 August 2025 and a charge‑sheet had been filed. The State opposed bail, citing the FIR allegations. The Court observed that the FIR did not disclose any serious allegation against the petitioner and, considering the elapsed custody and filed charge‑sheet, ordered his release on bail with a bond of Rs.10,000 and two sureties, subject to conditions of personal appearance and a relative as a bailor. The bail order was pronounced by Justice Smt. Soni Shrivastava.
Issues considered
- What is the appropriateness of granting bail to the petitioner under Section 309(4) of the B.N.S. given the facts and the FIR?
- Whether the FIR discloses any serious allegation against the petitioner warranting denial of bail?
