Monu Kumar @ Manu KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted regular bail to the petitioner.

Summary

Monu Kumar was arrested in connection with a case alleging that he, along with others, attacked an informant and his parents with iron rods, causing a fractured arm and a head injury, and also stole a gold mangalsutra and damaged a CCTV camera. The petitioner claimed he was innocent, asserted that the parties were agnates with a prior counter‑case filed by his father, and argued that the injuries were simple. He had been in custody since 22 November 2025 and sought regular bail. The State opposed the bail application, citing the seriousness of the offences listed under the Bihar Penal Code. The court considered the facts, the petitioner’s claim of innocence, the nature of the injuries, and the existence of a prior dispute, and decided to grant bail on a bond of Rs.10,000 with two sureties, subject to cooperation with the trial. The order released the petitioner on bail with conditions.

Issues considered

  • Whether the petitioner is entitled to regular bail despite the serious nature of the offences alleged under the Bihar Penal Code.
  • Whether the existence of a prior dispute and the claim of simple injuries justify granting bail.

  • regular bail
