Patna High Court

Pappu RamversusThe State of Bihar

Decided
Disposal
DISMISSED

Holding

The application for extension of time to surrender after anticipatory bail is dismissed.

Summary

The petitioner, Pappu Ram, was granted anticipatory bail by the Sessions Judge on 27 July 2022, with a condition to surrender within four weeks and furnish a bail bond. In 2025, three years later, he filed an application seeking an extension of the time allowed for surrender. The Sessions Judge rejected the extension on 11 July 2025. The petitioner appealed before the Patna High Court, contending that the delay in surrendering warranted an extension. The High Court examined whether the statutory provisions and precedent permit a court to extend the surrender period after anticipatory bail has been granted. Finding no merit in the petitioner's claim and noting the lapse of a considerable period, the Court held that the extension could not be granted. Consequently, the application for extension was dismissed, upholding the lower court's decision.
