Patna High Court

Bala Lakhindra KumarversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to strict conditions.

Summary

The petitioner, Bala Lakhindra Kumar, applied for anticipatory bail after a complaint was filed by Chandani Devi alleging offences under IPC sections 323, 307, 504, 506 and 34. The court observed that both parties wish to continue their marital relationship and the petitioner assured no dowry demand. Taking into account the petitioner's undertaking and the informant's presence, the bench was inclined to grant anticipatory bail. The order directed that the petitioner be released on bail within four weeks upon furnishing a Rs.10,000 bond with two sureties and complying with several conditions, including regular police appearances, non‑interference with witnesses, and refraining from further offences. Non‑compliance would permit cancellation of the bail. The court emphasized strict adherence to the stipulated conditions.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner in a case involving offences under IPC sections 323, 307, 504, 506 and 34
  • Whether the petitioner’s undertaking and the marital context justify the grant of anticipatory bail with conditions
